Illegal Recruitment (PD 442 v. RA 8042)

It is common knowledge that the crime of Illegal Recruitment can be committed in large scale and by a syndicate but there is one more thing we have to remember. When Illegal Recruitment, either in large scale or by a syndicate, is committed for local employment, the offenders must be prosecuted under the Labor Code (PD 442). On the other hand, when such illegal activity is committed promising overseas employment, the offenders must be prosecuted under RA 8042 or the Migrant Workers Law.
