Difference: service and filing

What is filing? Filing is the act of presenting the pleading or other paper to the clerk of court (Rule 13, Sec.2)

What is service? It is the act of providing a party with a copy of the pleading or paper concerned.

If any party has appeared by counsel, service upon him shall be made upon his counsel or one of them, unless service upon the party himself is ordered by the court. When a party is represented by counsel, service of notice should be made upon counsel and not upon the party, unless service upon the party himself is ordered by the court. (Rule 13, Sec. 2).

What papers are required to be filed and served? Every judgment, resolution, order, pleading subsequent to the complaint, written motion, notice, appearance, demand, offer of judgment or similar papers shall be filed with the court, and served upon the parties affected. Written Motion, Appearance, Pleading, Order, Notice, Demand, Offer of Judgment, Similar Papers, Judgement and Resolution. (Rule 13, Sec.4)
