There is no crime of frustrated theft. Theft is already “produced” upon the “taking of personal property of another without the latter’s consent.” There was no need for permanency in the taking or in its intent, as the mere temporary possession by the offender or disturbance of the proprietary rights of the owner already constituted apoderamiento.
