Sale of land or any interest therein via agency
Art. 1874. When a sale of a piece of land or any interest therein is through an agent, the authority of the latter shall be in writing; otherwise, the sale shall be void. (Civil Code of the Philippines)
The authorization must be written and specific. The authorization need not be written but must be specific: [1] if the contract is a sale of an immovable other than land; [2] if the contract transmits ownership over an immovable other than land; and [3] if the contract transmits ownership over land through a transaction other than a sale.
In other words, it must be sale of land. If the case is a donation of land, the authorization is sufficient without being written as long as specific (special power of attorney).
