Partition of estate by mistake

A partition which includes a person believed to be an heir, but who is not, shall be void only with respect to such person. (Article 1105, Civil Code) In case a person is included in a partition under a mistaken belief that such person is an heir, the partition shall remain valid but void with respect to the provisions in favor of such person.
